			<content:encoded><![CDATA[<p> A Chinese national was convicted this week of smuggling and other charges over his efforts to acquire sensitive military and NSA-encryption gear from eBay and other internet sources. Chi Tong Kuok, of Macau, told Defense Department and Customs investigators that he had been &#8220;acting at the direction of officials for the People&#8217;s Republic of China,&#8221; according to a government affidavit in the case. &#8220;Kuok indicated he and PRC officials sought the items to figure out ways to listen to or monitor U.S. government and military communications.&#8221; Kuok was arrested at the Atlanta International Airport last year en route from Paris to Panama, where he planned to meet an undercover federal agent he believed was going to provide him with military radios. He was transferred to California and indicted (.pdf) for money laundering, conspiracy, smuggling and one count of attempting to export a defense article without a license. On Tuesday, a jury convicted him on all counts. The U.S. began investigating Kuok in December 2006, when, using the first of many aliases, the man e-mailed a contact in the defense industry in search of software for a VDC-300 airborne data controller, used for secure satellite communications from American military aircraft. The contact referred Kuok to an undercover agent in San Diego, who began negotiating with Kuok over a shopping list of military technology that eventually grew to at least 43 different items, ranging from a GPS receiver with anti-spoofing defenses, to the NSA-developed AN/CYZ-10 crypto key management device. </p>

			<content:encoded><![CDATA[<p> Bank thieves have rolled out a new weapon in their arsenal of tactics &#8212; telephony denial-of-service attacks that flood a victim&#8217;s phone with diversionary calls while the thieves drain the victim&#8217;s account of money. A Florida dentist lost $400,000 from his retirement account last year in this manner, and the FBI said the attacks are growing. A spokeswoman for the Communication Fraud Control Association &#8212; a telecom industry organization &#8212; told Threat Level that although fraudulent transfers have been halted in a number of cases, the losses are increasing. &#8220;I know it&#8217;s in the millions,&#8221; said Roberta Aranoff, executive director of the CFCA. &#8220;It has exceeded a million dollars easily.&#8221; Last November, Robert Thousand, Jr., a semi-retired dentist in Florida, received a flood of calls to several phones. When he answered them, he heard a 30-second recording for a sex hotline, according to the St. Augustine Record . In December, he discovered that $399,000 had been drained from his Ameritrade retirement account shortly after he&#8217;d received the calls. </p>

			<content:encoded><![CDATA[<p> A federal judge has granted the FBI access to evidence linked to a webcam scandal at a Philadelphia suburban school district. Federal prosecutors in Pennsylvania said they were investigating &#8220; possible criminal conduct &#8221; (.pdf) in the 6,900-student Lower Merion School District. U.S. District Judge Jan DuBois is presiding over a federal civil lawsuit alleging the  district secretly snapped tens of thousands of webcam images (.pdf) of students using school-issued laptops, without the pupils&#8217; knowledge or consent. The judge had ordered the evidence in the case &#8212; which include the district computers  and thousands of pictures of high school children &#8211; sealed to protect the privacy of the students, temporarily frustrating federal law enforcement officials. But the judge  agreed Monday to release the evidence to prosecutors (.pdf), at the request of U.S. Attorney Michael Levy. Levy, in urging the judge to lift his order freezing evidence in the lawsuit, said the nondisclosure order &#8220;interfered with the government&#8217;s obligation to investigate possible criminal conduct occurring within this district.&#8221; It remains unclear whether under current law the  secret and remote filming of anyone, even minors, is a federal crime . A federal grand jury and the Federal Bureau of Investigation are looking into the district&#8217;s actions . The district claimed the cameras were activated a handful of times when a laptop was reported stolen or missing. </p>

Mueller, III has appointed Robert Anderson, Jr. special agent in charge (SAC) for the Intelligence Division in the FBI’s Washington Field Office (WFO). Most recently, Mr. Anderson served as chief of the Counterespionage Section in the Counterintelligence Division at FBI Headquarters. Mr. Anderson entered on duty as a special agent with the FBI in April 1995. Upon completion of training at the FBI Academy in Quantico, Virginia, he was assigned to WFO, where he investigated narcotic violations and violent crimes. In 1997, he was transferred to the Hostage Rescue Team (HRT), where he served as an assaulter and ran the HRT international medical program</p>

			<content:encoded><![CDATA[<p> Chanhassen Man Pleads Guilty to Lying to the FBI During Investigation of Missing Somali Men May 5, 2010 &#8211; A 26-year-old Chanhassen man pleaded guilty today in federal court in Minneapolis to lying to the FBI during the investigation into the recruitment of young men in the U.S. to train with and fight for extremist groups in Somalia. Appearing before U.S. District Court Judge James M. Rosenbaum, Abdow Munye Abdow pleaded guilty to one count of obstruction of justice in connection to his crime. He was indicted on October 13, 2009. In his plea agreement, Abdow admitted that on October 8, 2009, he obstructed an FBI investigation by making false statements to agents. </p>

			<content:encoded><![CDATA[<p> &#8220;I was expecting you,&#8221; suspected bomber Faisal Shahzad reportedly told the border agents who seized him from his Dubai-bound flight Monday evening. And clearly the suspect should have been expecting agents, given the trail of clues he allegedly left behind and the steps investigators were taking to close in on him, now detailed in a wealth of media reports. But even though Customs and Border Protection agents were also expecting Shahzad &#8212; his name was on a no-fly list &#8212; he managed to slip past airline personnel and board his plane unhindered, only to be caught at the last minute as Emirates flight EK202 was preparing to pull back from its gate. The near-miss arrest has exposed some flaws in the passenger-screening process, and prompted changes by the Transportation Security Administration. But it also highlights the quick investigative efforts that led authorities to target the suspect in the first place. By all accounts, the 55 hours between the time a vendor first noticed smoke billowing from a Nissan Pathfinder parked in Times Square &#8212; its engine still running &#8212; to the minute Shahzad was nabbed were a whirlwind of investigative activity that was greatly aided by Shahzad&#8217;s apparent lack of subterfuge skills. The trail started with the Pathfinder. Inside, police found a number of keys, including one to an Isuzu automobile &#8212;  it would later develop that Shahzad was the registered owner of a 1998 Isuzi Rodeo &#8211; and one that turned out to open the front door of Shahzad&#8217;s Connecticut home, according to the  criminal complaint (.pdf) filed against him in New York</p>

			<content:encoded><![CDATA[<p> Manhattan U.S. Attorney Charges Faisal Shahzad with Attempted Car Bombing in Times Square PREET BHARARA, the United States Attorney for the Southern District of New York, GEORGE VENIZELOS, the Special Agent-in-Charge of the New York Office of the Federal Bureau of Investigation (&#8220;FBI&#8221;), and RAYMOND W. KELLY, the Police Commissioner of the City of New York, announced that FAISAL SHAHZAD was charged today with attempted use of a weapon of mass destruction, acts of terrorism transcending national boundaries, and other federal crimes for allegedly driving a car bomb into Times Square on the evening of May 1, 2010. SHAHZAD, a naturalized U.S. citizen born in Pakistan, was taken into custody at John F. Kennedy International Airport on May 3, 2010, after he was identified by the Department of Homeland Security&#8217;s U.S. Customs and Border Protection while attempting to leave the United States by means of a commercial flight to Dubai. According to the Complaint filed today in Manhattan federal court: In April 2010, SHAHZAD contacted the seller of a Nissan Pathfinder after seeing an advertisement posted on a website. Thereafter, on April 24, 2010, SHAHZAD and the seller of the Pathfinder agreed to meet in a supermarket parking lot in Connecticut, where SHAHZAD paid the seller $1300 for the Pathfinder. On May 1, 2010, a Pathfinder was discovered, abandoned, on the street in Times Square</p>

It is my pleasure to address you today regarding the FBI’s efforts to respond to attempted purchases of firearms from licensed dealers and applications for firearms and explosives permits from state agencies by Known or Appropriately Suspected Terrorists (KSTs) listed on the nation’s consolidated watch list. First, I want to make it clear that the FBI takes a proactive approach to investigating persons suspected of being involved or associated with terrorism. Our Joint Terrorism Task Forces (JTTFs) are engaged every day, across the country, in following up leads, monitoring intelligence, and otherwise pursuing information about suspected terrorists who may be trying to obtain the means by which they or their associates can do harm to this country and its citizens. Our efforts to identify watchlisted KSTs attempting to obtain firearms includes, but is not limited to, use of the National Instant Criminal Background Check System (NICS) process. </p>
